Supreme Court dismisses Magnus Abe’s suit on Rivers APC primaries

The Supreme Court has dismissed a suit filed by Magnus Abe on the primaries of the All Progressives Congress (APC) in Rivers State.

Abe is a factional leader of Rivers APC.

He had prayed the apex court to determine the authenticity or otherwise of the direct primary conducted by Rivers APC for the nomination of its candidates for 2019 general elections.

He had also asked to court to make a final pronouncement on the legality of both direct and indirect primary polls conducted by two factions of Rivers APC in 2018.

Acting Chief Justice of Nigeria (CJN), Mohammed Tanko, in a unanimous judgement on Monday, dismissed the application on the ground that it lacks merit.

The court also noted that the suit is incompetent and a gross violation of order 2 rule 8 of Supreme Court rules.

It also held that once a notice of appeal has been found defective, it cannot be amended.
