Supreme Court to deliver judgement on Onnoghen’s suspension May 17

The Supreme Court will on May 17 deliver judgement in a suit filed by Cross River State Government which seeks to upturn the suspension of the Chief Justice of Nigeria (CJN), Walter Onnoghen.

Justice Olabode Rhodes-Vivour led a seven-man panel on Thursday in fixing the date.

Counsels to both parties had argued for their clients before the date was fixed.

Cross River State Government counsel, Lucius Nwosu, said that Onnoghen’s suspension based on an ex-parte order by a lay magistrate (Chairman of the Code of Conduct Tribunal) violates section 292 (1) of the Constitution.

Counsel to the AGF, Dayo Apata, said the plaintiff (Cross River State) lacked the locus standi to table the matter before the Supreme Court since Onnoghen’s suspension cannot be treated as a dispute between the Federal Government and the State Government.
