Court to decide Ifeanyi Ubah’s fate January 17

The FCT High Court on Thursday fixed January 17 to rule on an application filed by Senator Ifeanyi Ubah which calls for the upturning of a judgment entered against his election to occupy the Anambra South Senatorial seat.

Justice Bello Kawu of the Federal High Court in Abuja had ordered the Independent National Electoral Commission (INEC) to issue a certificate of return to Obinna Uzoh as senator-elect for the district.

Justice Kawu delivered the judgment in a pre-election matter brought before him by Uzoh of the Peoples Democratic Party (PDP).

Uzoh had claimed that Ubah presented a forged National Examination Council (NECO) Secondary School Certificate to INEC.

He also instituted a suit challenging Ubah’s party, the Young Progressives Party (YPP), for not conducting an ‘acceptable’ primary election for the senatorial election.

Uzoh urged the court to declare him winner of the election following the disqualification of both candidacies of YPP and Ubah.

According to him, both YPP and Ubah’s participation in the election were not in non-compliance with the provisions of the Constitution and the Electoral Act, 2010.

Ubah is contending that the judgment was entered against him in his absence. He said the application was predicated on lack of fair hearing.
