Appeal Court upholds judgement nullifying Omo-Agege’s election

The Court of Appeal sitting in Benin, Edo State capital, has dismissed appeals by Senator Ovie Omo-Agege and Francis Waive, seeking leave of court to challenge the judgement of the Federal High Court, Asaba, which nullified their elections.

Justice Philomena Ekpe in her ruling on Friday said the appeals lacked merit and fined the two applicants N300,000 each.

Omo-Agege and Waive emerged as Delta State candidates of All Progressives Congress (APC) for 2019 general elections from Jones Erue-led faction which the Asaba Federal High Court had sacked as chairman.

Waive is the member-elect of House of Representatives to represent Ughelli North, Ughelli South and Udu federal constituency.

The Asaba court had also declared Cyril Ogodo, who filed the suit, as authentic chairman of APC Delta.

In Friday’s ruling, the Appeal Court said Omo-Agege and Waive could not claim to be unaware of the case thus could not seek to be joined or challenge the judgement at this moment.
