Mompha slams N5m suit on EFCC over rearrest

Instagram celebrity Ismaila Mustapha popularly known as Mompha has filed a suit against the Economic and Financial Crimes Commission (EFCC) for rearresting him on August 14.

Mompha filed the suit at the Federal High Court in Lagos, seeking N5million damages.

Mompha who is facing money laundering charges before a Federal High Court in Lagos was re-arrested when he went to the EFCC office in Ikoyi, Lagos to reclaim his five wristwatches, one Apple Air pod, one iPhone 8 mobile phone and one pair of sunglasses, seized from him by the anti-graft agency.

Justice Mohammed Liman had on July 24 ordered the EFCC to release the items to Mompha following an application by his lawyer Gboyega Oyewole.

In the suit filed by Mr Oyewole on Tuesday, Mompha prayed the court to declare that his re-arrest and detention by the EFCC was unjustifiable and unlawful.

He is equally urging the court to declare that the continued seizure of the items violated his right to own property under Section 44 of the constitution.

The social media celebrity is also praying the court to order the EFCC not only to free him but also to give him back the seized items.

EFCC spokesman Dele Oyewale had said Mompha’s rearrest was connected to fresh internet fraud charges.

No date has been fixed for the hearing of Mompha’s N5million suit.
