Court remands soldier accused of raping AAUA student

Sunday Awolola soldier who allegedly raped AAUA student

A Magistrate Court has ordered that the soldier, Sunday Awolola, accused of raping a 300-level student of the Adekunle Ajasin University, Akungba Akoko (AAUA), Ondo State, be remanded in prison custody.

Magistrate Mayowa Olanipekun gave the fresh order on Friday.

The soldier was remanded in police custody on his arraignment on Wednesday.

Awolola, 33, attached to the 32 Artillery Brigade of the Nigeria Army, allegedly raped the student at a military checkpoint along Ikare Akoko-Akungba Akoko road on July 31, 2019.

The Nigerian Army dismissed him before he was handed over to the police for prosecution.

Police prosecutor, Adeoye Adesegun, said the alleged crime contravened section 357 and punishable under section 358 of the criminal code cap 37 vol. Laws of the Ondo state of Nigeria.

Mr Adesegun told the court that the case file had been transferred to the Director of Public Prosecution of the Ondo State Ministry of Justice for legal advice.

He also prayed the court to remand the accused person in the prison custody pending the outcome of the DPP’s legal advice on the matter.

The accused’s lawyer, Kayode Ikotun, who filed an affidavit against the application said the court had no jurisdiction to hear the case.
