Alleged rape: Court strikes out suit remanding Moses Armstrong

A magistrate court in Uyo, Akwa Ibom, has struck out a suit by the prosecution seeking to remand actor Moses Armstrong in custody.

Judge Moreen Udoka dismissed the suit on Tuesday when A. Nyongessien, the prosecutor, mentioned that it has been filed at the State High Court.

The court also approved the transfer of the alleged rape case to the State High Court.

The development makes it the second time that different judges would strike out the suit.

The first Judge, Samuel Ukoima, whose court Mr Armstrong was first arraigned on June 17, had struck out the prosecution’s remand application on the basis that it was not properly filed. Ukoima ordered that the actor be rearrested after the case had been properly filed.

The actor had been remanded for 21 days in a correctional facility to enable the prosecution to file a case at the high court after the lower court struck out the case based on jurisdiction.

Further hearing on the suit would be at the State High Court.

Qed.ng reported that the police arrested Moses in June for allegedly having sex with a minor. He allegedly committed the act with a 16-year-old girl about three years ago.

The alleged victim, who was said to have been schooling abroad, returned to the country recently and petitioned Martha Udom Emmanuel, the wife of the state governor with respect to the rape allegation.
