A Federal High Court in Abuja has rejected a request to stop Ireti Kingibe from taking part in activities of the African Democratic Congress (ADC) over her alleged suspension.
Justice Peter Lifu ruled that the application filed by party leaders in Wuse Ward could not be granted without hearing from the senator.
The judge ordered the plaintiffs to serve Senator Kingibe with all court documents to enable her respond to the suit.
He said such requests in political matters must be handled with care and that both sides must be heard before a decision is taken.
The suit was filed by Okezuo Anayo and Isaiah Samuel on behalf of ward members.
They said the senator was suspended on March 10, over alleged anti-party activities, misconduct and disregard for the party’s constitution.
They asked the court to restrain her from presenting herself as a party member, attending meetings or carrying out party activities.
They also accused her of holding meetings, issuing statements and interfering in ward affairs after the suspension.
“Her actions constitute flagrant disregard to the internal mechanism of the party,” the plaintiffs said.
A lawyer Abubakar Marshall said he represents Ireti Kingibe and has filed a preliminary objection to the suit.
The court fixed April 20 for hearing of the case.
